The Judiciary of Eswatini, in collaboration with UNICEF Eswatini and key justice-sector partners, convened the Judiciary Dialogue on Children in Conflict and in Contact with the Law on 24 July 2026.

The dialogue brought together Judges, Magistrates, the Registrar of the High Court, representatives of the Commission on Human Rights, the Director of Public Prosecutions, the Royal Eswatini Police Service, the Department of Social Welfare and the Children’s Department. Participants reflected on how the justice system can better respond to children appearing as victims, witnesses or alleged offenders with fairness, dignity and care.

Discussions focused on placing the rights and best interests of the child at the centre of judicial decision-making, strengthening coordination among justice institutions and promoting practical child-friendly approaches such as diversion, restorative justice, alternatives to detention, reintegration support and access to legal assistance.

The dialogue also examined important principles emerging from case law, including the need to hear the child’s views, base maintenance decisions on evidence and give primary consideration to the best interests of children in matters affecting their welfare.

The programme reinforced the importance of accessible, timely and child-sensitive justice processes that protect children’s privacy, dignity and right to be heard. It further emphasized the need for trained professionals, coordinated support services and procedures adapted to children’s age, circumstances and evolving capacities.

The Judiciary remains committed to working with UNICEF and other stakeholders to strengthen a justice system that protects children, respects their rights and supports their positive development.
