Constitutional Body
The Judicial Service Commission safeguards the independence, integrity and effectiveness of the judiciary in Eswatini. Established under the Constitution, the JSC plays a crucial role in the appointment, discipline and removal of judicial officers.
The JSC’s authority and responsibilities are derived from the Constitution of Eswatini.

The Judicial Service Commission consists of six members (Constitution, section 159(2)):

Chairperson of the Commission
Hon. Chief Justice Bhekie M. C. Maphalala
The Chief Justice chairs the Judicial Service Commission and leads the Judiciary of Eswatini. He also serves as Chairperson of the Southern and Eastern Africa Chief Justices’ Forum (SEACJF).
Role and responsibilities: Leads the Commission and ensures its proper functioning.
Appointment process: Appointed by the King in accordance with constitutional provisions.
Term of office: Serves as Chairperson for the duration of their tenure as Chief Justice.
The Chairman of the Civil Service Commission sits on the Commission by virtue of that office (Constitution, section 159(2)(c)).
Two legal practitioners of not less than seven years’ practice and in good professional standing, and two other persons, are appointed by the King (Constitution, section 159(2)(b) and (d)). A member so appointed holds office for a period not exceeding four years and is eligible for re-appointment for one further period (section 159(4)).
In the exercise of its functions under the Constitution, the Commission and its members are not subject to the direction or control of any person or authority (Constitution, section 159(3)).
Administrative role: Coordinates the Commission’s activities and maintains records.
Support functions: Provides administrative support to the Commission.
Record-keeping: Maintains minutes, decisions, and other important documentation.

The JSC oversees the appointment of various judicial officers within the judiciary.
